Vietnam should use China's ratification of the UNCLOS to challenge China's claim. By ratifying the said law China agreed to the delimitation of the seas. That is, each and every maritime country has a 12 nautical mile territorial sea, and a 200 nautical mile exclusive economic zone (EEZ). Then by claiming that China owns other maritime country's waters was a direct violation of China's agreement. Armed with this violation, Vietnam can defeat China's claim by asking China: Mr. President Xi, do we have a territorial sea and a EEZ?
